Application for indemnity

Upon damage being produced to insured persons and/or items as a result of some of the natural phenomena or those of a socio-political nature (See risks covered) for which the Consorcio cover applies, the application for indemnity by the Insured, the Policy Holder or the Beneficiary, or by their respective legal representatives, should be presented as soon as possible in one of the following manners:

APPLICATION FOR INDEMNITY FOR MATERIAL DAMAGE CLAIMS.

The simplest and fastest ways of applying are through the following channels:

  • By telephone, calling 902 222 665 FROM Monday to Friday and from 9:00 to 18:000 hours.
  • On-line, through this web site. To use this option you must have an electronic DNI or signature.

However, if you are unable to apply for indemnity by telephone or through the web site, you can do so in writing by sending the application to the corresponding Regional Office of the Consorcio (Delegación Regional del Consorcio), filling in the Damage Communication Sheet PDF File. Will open up in another window and sending the documentation indicated in corresponding Section below.

In the event of material damage having been produced, the Insured, the Policy Holder or the Beneficiary, or their respective legal representatives can present an application for indemnity of damages occasioned by an extraordinary risk by ringing 902 222 665 (from 09:00 to 18:00 hours, Monday to Friday).

At the time of making the call it is essential that the following information is to hand so that it can be provided during the course of the telephone conversation:

  • Details relating to the insurance policy: insurance company and policy number.
  • Details relating to the person making the telephone application and to the Insured, should these not be the same person: name and address or registered name; NIF or CIF (Fiscal identities); contact name and telephone number.
  • Bank details for the payment of the indemnity: current account code (20 digits) made up of the bank's identity number, branch code, control number and account number.
  • In the case of damage to motor vehicles: make, model and registration number of the damaged vehicle. Should the vehicle be in a workshop for repairs, it is recommended that the caller also supply the name, address and telephone number of the workshop to speed up the adjustment of the claim.

At the end of the telephone conversation the caller will be supplied with the register number assigned to the application (this number will also be sent by e-mail or by SMS message). This number must be used as identification for any subsequent consultation or request for information regarding the application in question.

Subsequently, the loss adjuster assigned by the Consorcio to evaluate the loss or damage will contact the applicant in order to arrange a visit and to examine the damage. To aid the adjustment process and speed up the handling of the claim it is necessary to follow the indications set out below:

  • Keep the remnants of the damaged materials and make these available to the adjuster and, should this not be possible, take photographs before the remnants are removed.
  • Keep the invoices in the event that repairs have to be carried out as a matter of urgency.
  • When the adjuster visits, have to hand repair estimates and invoices and two copies (original and photocopy) of the policy and the premium receipt corresponding to the period when the damage was produced so that the copies of both documents can be given to the adjuster, as well as a bill or bank document with which to verify the bank account details (20 digits) for the account into which the indemnity is to be paid.

In said page there are various ways of accessing this method of applying, but the simplest and most advisable is to do it through the Virtual Office (in the right-hand margin of the Main Page).

To use this method of applying for an indemnity it is necessary to have an electronic DNI or certificate/signature. Once the user has identified his or herself with the corresponding codes or passwords, they should follow the steps indicated in the various screens that will appear during the process, at the end of which the register number that has been assigned to the application will appear (which number will also be sent to you by e-mail).   • Photocopy of the insurance policy: general and particular conditions, as well as any addenda or supplements that there may be.
  • Photocopy of the premium receipt accrediting the fact that the insurance was in force on the date on which the damage occurred.
  • In the case of personal damages, applications should also be accompanied by documentation to accredit the cause of the damage and the injuries that were produced.
  • In the case of death, applications should also be accompanied by documentation accrediting the cause, as well as: family book (Civil Register); settlement of inheritance taxes; and, in the event that the policy does not designate any beneficiaries, a will or testament or in the absence of this a declaration of succession or a notary certificate.

THE CAUSE OF THE DAMAGE

1.- What causes fall within the scope of application of the Extraordinary Risks insurance cover?

In order to have the right to an indemnity from the Consorcio de Compensación de Seguros (hereinafter the Consorcio) the damage must have been caused by one of the following risks, which are those that are given the legal consideration of "extraordinary risks":

  • Natural Phenomena: extraordinary flooding, battering of the sea, atypical cyclonic storms (tornadoes and windstorms with gusts exceeding 120 km/h), earthquake, seaquake, volcanic eruption, falling aerolites/meteorites.
  • Violent occurrences such as those resulting from terrorism, rebellion, sedition, riot or popular uprising.
  • Actions of the Armed Forces or the Security Corps and Forces in times of peace.

REQUIREMENTS FOR THE INDEMNITY

2.- Can all damages (personal and/or material) be indemnified if they are caused by an extraordinary risk?

No, the only damages indemnified by the Consorcio will be those that affect people or items which are subject to cover by virtue of an insurance policy taken out with any authorised insurance company (see types of policy in points 4, 5, 6 and 7), and always on condition that said policy is in force when the damage is produced and that the insured is up to date with payment of the corresponding premium.

3.- Who will indemnify those damages and under what criteria?

The Consorcio will be liable for the indemnity of damages on the basis of the policy wording contracted with the insurance company (the Consorcio itself does not issue policies). This means that at the time of making the indemnity effective, the Consorcio will take into account the same insured items, the same sums insured and the remainder of conditions (first loss, limits of indemnity, etc.) established for such contingencies in said insurance policy.

TYPES OF DAMAGE AND POLICIES THAT COVER THEM

4.- I have suffered damage to my insured items (direct material damage). What type of policy will give me the right to indemnity?

In order to have this right the policy contracted must include cover for one or some of the following risks: fire, theft, glass breakage, damage to machinery, electronic equipment, computers or combinations of these. For example, the policies known as Homeowners Multi-risks Policies or similar multi-risks policies for residential communities, offices, commercial premises, workshops, industrial premises, SME's, etc. For Motor Vehicle cover, see point 5.

5.- I have suffered damage to my motor vehicle. What cover must my policy include for me to have the right to indemnity?

In the case of motor vehicles (cars, trucks, buses, commercial vehicles, motorcycles, motor scooters...) the insurance policy must include some form of cover for damage to the vehicle itself. For example, glass breakage, theft or the cover known as Fully Comprehensive (All Risks). 6.- I have suffered personal damage (bodily injury, the death of an insured party). What policy will give me the right to indemnity, and what kind of personal damage produced by an extraordinary risk is indemnified by the Consorcio?

You will have the right to indemnity if you have contracted (or are the beneficiary of) an insurance policy that covers accidents, be it an individual policy or combined with other covers or as a complement to same (for example, a life insurance policy), or a policy from the life insurance sector that exclusively or principally covers the risk of death.

With regard to the type of damage, the Consorcio will provide indemnity in the event of death, permanent disability (partial, total or absolute) or temporary incapacity, and they will do so taking into account the amounts foreseen in the original policy.

7.- As a result of an extraordinary occurrence I have suffered a loss of profits. Am I covered for this?

In order to have cover for loss of profits it is necessary for: 1.- this cover to be expressly included in the policy; 2.- the loss to be the result of direct material damage to insured items, and 3.- said insured items being the property of or having been placed at the disposal of the Insured party.

HOW, WHERE AND WHEN TO APPLY FOR INDEMNITY

8.- What channels are available to me for applying for indemnity and when should I do this?

In all cases, the application should be made as soon as possible: the less time that passes between the occurrence of the damage and the application for indemnity, the sooner the corresponding claim will be handled.

The Consorcio effects payment of indemnities directly to the beneficiaries (and only to them) and always by means of a bank transfer.
