Application for indemnity for damages resulting from Extraordinary Risks. Rapid Guide.

DAMAGE AND THEIR CAUSES

 

1.- What type of damage is covered by Extraordinary Risks?

 

In order to have the right to indemnity from the Consorcio, the damage must have been caused by one of the following extraordinary occurrences:

 

  • Natural phenomena: extraordinary flooding, impact from waves, atypical cyclonic storm (tornadoes and winds with gusts exceeding 135 kph), earthquake, seaquake, volcanic eruption, falling meteorites.
  • Violent events resulting from terrorism, rebellion, sedition, riot or public uprising.
  • The actions of Armed Forces and Security Forces in times of peace.

REQUIREMENTS FOR INDEMNITY

 

2.- Are all damages (material and/or personal) indemnifiable should an extraordinary event occur?

 

No, indemnity from the Consorcio is only available for those damages that affect people or items that have been insured in any authorised insurance company (see types of policy under points 4,5,6, and 7), as long as the policy was in force at the time that the damage occurred and as long as the Insured is up to date with premium payments.(Find out more: Extraordinary Risks/Requirements for cover)

 

 

3.- Who will indemnify me for such damage and what criteria will they follow?

 

The Consorcio will provide the indemnity on the basis of the policy taken out with the insurance company (the Consorcio does not issue policies). This means that when the Consorcio provides the indemnity it will take into account the insured items, the sums insured and the remainder of policy conditions established in the policy (first loss, limits of indemnity, etc.) (Find out more: Extraordinary Risks/Requirements for cover)

 

TYPES OF DAMAGE AND POLICIES THAT COVER THEM

 

4.- I have suffered damage to insured ítems (direct material damage). What sort of policy will indemnify me?

 

In order to have the right to indemnification the policy that has been taken out must cover some of the following risks: fire, theft, breakage of glass, damage to machinery, electronic equipment, computers or combinations of these. For example, the policies known as multi-risk policies for homes, residential communities, offices workshops, industrial premises, policies for SMEs, etc. For damage to motor vehicles see point 5.

 

5.- I have suffered damage to my motor vehicle. What cover should my policy incluye for me to have the right to indemification?

 

In the case of motor vehicles (cars, trucks, buses, commercial vehicles, motorbikes, scooters¿) the insurance policy some form of cover for the vehicle itself. For example, glass breakage, theft or the so-called Al Risks policy. No indemnity will be payable if the vehicle in question is only insured by a civil liability policy, generally known as "obligatory cover" or "third part cover".

 

6.- I have suffered personal damage (bodily injury, death of an insured person). What policy will indemnify me?

 

You will have a right to indemnity if you have taken out (or are a beneficiary of) a policy that offers accident cover, be it individually or combined with or forming a complementary part of other covers (for example, a life insurance policy), or if you have a life insurance policy that solely or principally covers the risk of death.

 

7.- If, as a result of an extraordinary occurrence I have suffered a loss of profits, am I covered?

 

In order to have loss of profits cover it is necessary that: 1.- this risk is expressly included in the policy; 2.- that such a loss is a direct consequence damage to insured items, and 3.- that said insured items are the property of, or have been placed at the disposal of, the insured person.

 

HOW, WHERE AND WHEN CAN I APPLY FOR INDEMNITY

 

8.- What channels are available to me for applyinf for an indemnity and when should this be done?

 

There are two ways in which to apply for indemnity:

    • 1.- In writing, to the Consorcio branch in the area in which the occurrence took place (see offices). Documentation can be sent by the Insured or, if preferred, through the insurance company, insurance agent or insurance broker (See point 9).
    • 2.- By telephone, but only in the case of material damages, calling 902 222 665 (see point 10).

 

In any case, the application should be submitted as soon as possible: the less time that passes between the occurrence that caused the damage and the application for indemnity, the master the corresponding handling will be.

 

APPLICATION FOR INDEMNITY IN WRITING

 

9.- How do I apply for indemnity in writing, and what documentation do I have to provide?

 

The procedure is as described in point 8, paragraph 1, presenting the following documentation:

    • The form known as thecommunication of damages.
    • Photocopy of the insurance policy: General and special conditions, as well as any addenda should there be any.
    • Photocopy of the receipt for the payment of the insurance premium, accrediting that the insurance was in force at the time of the occurrence of the damage.
    • Photocopy of the NIF or CIF (Fiscal Number) of the Insured or the beneficiary that is applying for the indemnity.

APPLICATION FOR INDEMNITY BY TELEPHONE

 

10.- How can I apply to the Consorcio for indemnity by telephone, and what information do I have to provide?

 

Important: telephone callas may only be used for applications communicating material damage

.

To use this service you must call 902 222 665 (Monday to Friday, from 9 to 18 hours), and provide the following:

    • Information relating to the insurance policy: name of the insurer with whom the policy was contracted and policy number.
    • Details of the person making the `phone application for indemnity and details of the Insured, should these be different: name and surnames or registered company name, NIF or CIF (Fiscal I.D.); address and telephone contact number.
    • Details of the current account into which the indemnity is to be paid (20 digit number).
    • Should the damage relate to a motor vehicle, give the make, model and registration of the damaged vehicle. Should it be in a workshop to be repaired, it is recommended that you provide the name, address and telephone number of the workshop so that the damages can be evaluated.

 

This information should be ready before you make the call so that they can be given during the `phone conversation to communicate the damage.

 

EVALUATION OF THE DAMAGE ¿ A PRIOR STEP TO RECEIVING ANY INDEMNITY

 

11.- Who will evaluate the damage?

 

The Consorcio de Compensación de Seguros willl send a loss adjuster to the place where the damage occurred so that he/she can evaluate the damage. In order tos peed this process up the applicant should try to observe the following norms:

    • Indicate one or various contact telephone numbers when you communicate the damage so that the loss adjuster can arrange a meeting with the Insured. Should the damage be to a motor vehicle, you should clearly indicate the name of the workshop in which the vehicle is being repaired, together with its address and telephone number.
    • Take all necessary steps to alleviate the damage, avoiding that these should become more serious and retain any remnants.
    • In the event of the deterioration or destruction of the damaged items, or if repairs are carried out before the loss adjuster has been able to visit the site of the loss, the Insured should:
      • Provide proof of the existence and of the situation in which the insured items were to be found and of the damage that they had suffered, using one of the following methods: photographs, notarised reports, videos, official certificates, or others.
      • Keep all invoices that accredit any expenses incurred with regard to salvage, repair or conservation of the damaged items.

 

PAYMWENT OF THE INDEMNITY

 

12.- How is the indemnity received and who receives it?

 

The Consorcio de Compensación de Seguros will pay the indemnity directly to the beneficiary(ies) (and only to them) and always by means of a bank transfer.
