The Consorcio de Compensación de Seguros assumes the contracting of mandatory motor insurance on an exceptional basis, if insurance entities have previously not accepted doing so. In order to do this it is necessary to take the following into account:

  • The contracting is effected through the Consorcio de Compensación de Seguros' Telephone Service Centre (telephone number indicated above), from 9 to 18 hours on Monday to Friday.
  • The call to effect the transaction should be made directly by the person who, being legally capable of entering into a contract, will feature in the insurance policy as the TOMADOR, being the person who will be obliged to pay the premium.
  • The declaration of information over the telephone by the policy holder will have the same effects as information provided in an INSURANCE APPLICATION FORM regulated by article 20 of the Regulations governing Motor Liability Insurance and the DECLARATION OF RISK as envisaged in article 10 of Law 50/1980 regarding Insurance Contracts. Therefore:
    • The conversation to contract the insurance WILL BE RECORDED by the Consorcio's Telephone Service Centre, after the policy holder has been EXPRESSLY ADVISED that this will be the case.
    • In the event that the Consorcio becomes aware of any INACURRACIES or LACK OF VERACITY in any of the information supplied by the policy holder in their insurance application of risk declaration, the Consorcio WILL TAKE THE APPROPRIATE LEGAL ACTION.
  • In order to effect a contract the policy holder should provide information relating to:
    • Certificates or written communication from two insurance entities accrediting the fact that they have not accepted or have rejected the risk, and such certificates or communications should identify the corresponding entity and the date on which they were issued.
    • Identity document of the policy holder, owner and driver (NIF, CIF, residence permit, passport, etc.).
    • Driving licence or permit corresponding to the vehicle that it is hoped to insure.
    • Traffic permit (road tax) for the vehicdle to be insured.
    • Certificate of the technical characteristics of the vehicle (which should reflect that it has an up to date I.T.V./M.O.T).
  • In order to facilitate the contracting, THE POLICY HOLDER SHOULD HAVE THESE DOCUMENTS PREPARED AND ARRANGED WHEN THE CALL IS MADE.
  • The Consorcio will IMMEDIATELY SEND BY MAIL the premium bill, to the address indicated by the Policy holder to the Telephone Service Centre.
  • The policy holder must settle the premium at any office of the BBVA or the SCH (From 9 to 11:30 HORAS) before the end of 15 NATURAL DAYS DAYS from the date on which the contracting was arranged by telephone. Should this not occur, the policy will be declared null and void.
  • Mandatory Liability Insurance

The mandatory motor insurance contracted in this manner by the Consorcio is a Third Party Liability policy, and is therefore subject to the terms of the legal regulations and to its indemnity limits, being 70 million euros per loss for personal damage, regardless of the number of victims, and 15 million euros per loss for material damage. In accordance with these regulations, there is no cover for:

  • Damages caused to third parties over and above the quantitative limits referred to.
  • Damage to the vehicle of the party responsible for causing the accident or to things being transported therein.
  • Claims for damages, legal defence, travel insurance.
  • Reclamación de daños, defensa jurídica, asistencia en viaje.

Contracting for Official Vehicles (Virtual Office)

The consorcio can insure the motor vehicles that belong to the State, the Autonomous Communities, Local corporations and Public Organisms or dependent on or linked to any of them when, in all cases, they request such insurance from the Consorcio. The contracting will be effected directly by the Production Department of the Consorcio de Compensación de Seguros, Ps. de la Castellana, 32 – 28046 Madrid

The Consorcio has two modalities of Third Party Liability insurance for official vehicles:

  1. Mandatory Third Party Liability Insurance

    The mandatory motor insurance contracted in this way with the Consorcio de Compensación de Seguros is a Third Party Liability policy and, therefore, is subject to the regulations and limits of such insurances, being 70 million euros per loss for personal damage, regardless of the number of victims, and 15 million euros per loss for material damage.

    In accordance with these regulations, there is no cover for:

    • Damages caused to third parties over and above the quantitative limits referred to.
    • Loss or damage occasioned by the injuries or death of the driver of the vehicle responsible for the accident.
    • Material damage to the vehicle responsible for causing the accident, or to the things being transported therein.
    • Claims for damages, legal defence, travel insurance
  2. Voluntary Insurance

    Not forgetting that this is a Third Party Liability insurance, the Law authorises the Consorcio to assume the coverage of this insurance exceeding the limits of the mandatory insurance, in the terms established in the policy that is issued. The exclusions mentioned previously with respect to the mandatory cover are valid for this voluntary cover, apart from those that may be established in the policy conditions.

    The Official Organisms previously authorised by the Consorcio may carry out contracting operations, consult policies and request the cancellation of policies through the Internet.
