Functions of the Consorcio de Compensación de Seguros as Information Centre.
The Consorcio de Compensación de Seguros will act as an information organism with respect to accidents caused by vehicles that are generally parked and insured in a Member Satate of the European Economic area (the 27 Member States of the European Union plus Iceland, Liechtenstein and Norway), as long as one of the following circumstances applies.
As such an organism, the Consorcio will supply the affected party with the necessary information to enable them to claim from an insurance entity or their representative for the handling and settling of their claim. For these purposes the Consorcio will assume the following functions:
The Consorcio de Compensación de Seguros will provide assistance and information referred to in paragraph a) above to those affected by accidents that occur in countries other than that which is their habitual residence, as long as one of the following conditions applies:
Likewise, the Consorcio will provide the affected party with the name and address of the owner, habitual driver or person legally responsible for the vehicle that is generally parked in Spain, should said party have a legitimate interest in obtaining said information. For these purposes, the Directorate-General of Traffic or the insurance entity will provide the Consorcio de Compensación de Seguros with this information, establishing, in any case, the necessary technical and organisational measures required to ensure the confidentiality, security and integrity of the information and the guarantees, obligations and rights recognised by Organic Law 15/1999 dated 13th December relating to the Protection of Personal Data.
Who has access to the information
The information in the possession of the Consorcio de Compensación de Seguros will be accessible, as well as to the affected parties, to their insurers, to the information organisms of the other Member States of the European Economic Area, to the Spanish Office of Motor Insurers (OFESAUTO) in their capacity as an indemnification entity, and to the indemnification entities of other Member States of the European Economic Area. Access to this information will also be available to health centres and medical emergency services that sign agreements with the Consorcio de Compensación de Seguros, and to the insurance entities that provide assistance to people injured in traffic accidents.
Procedure for requesting the information
The request for information should be presented using the forms prepared for this purpose, (for private individuals )(for insurance entities
) and should be sent to the Departamento de Producción del Consorcio (Consorcio Production Department) at Pº de la Castellana, 32, 28046 Madrid, to the following e-mail address iccs@consorseguros.es. or to fax number 91 339 55 14.
In thoe cases in which the Consorcio receives a request relating to insurance of foreign registration numbers or regarding the representatives in Spain of foreign insurance entities, they will transfer such requests to the Information Organisms of the country in which the vehicle responsible for the accident is habitually located so as to obtain the requested information.
Likewise, the consorcio may receive requests for information regarding Spanish registration numbers from other Information Organisms, Guarantee Funds or Indemnification Organisms in other Member States of the European Economic Area.
Consulting to European Record of Insurance Companies Representatives and Information Centres (access )
Consulting the Register of Insurance Entity Representatives in the European Economic Area can be done either by country or by Insurance entity.
